Terms of Service

Use of services provided by MPG constitutes acceptance of, and agreement to, the MPG Acceptable Use Policy (AUP) as well as these Terms of Service (TOS). In this TOS and AUP, “us,” “we,” “our” and “ours” refer to MPG (Midnight Publishing Group, Inc.), and “you” and “your” refer to the client or customer of MPG.

Acceptance of agreement

By placing an order, whether through an online form, a written contract or a verbal agreement, and receiving the services from MPG, you agree to our TOS and AUP.

MPG will provide, and the Customer will purchase and pay for, the services and service fees specified in the order or quote for the applicable service. The Customer acknowledges that the services and fees have been communicated to them and that they are aware of all applicable charges. Promotional offers apply only when they are specified in the Customer’s agreement.

Acceptable use: what may not be hosted on our servers

• Hacking tools, malware, phishing pages or warez
• IRC or eggdrop bot servers
• Child sexual abuse material
• Copyrighted media you don’t have the rights to, including but not limited to imagery, video, music, TV and radio
• Any illegal, fraudulent, misleading or incriminating data, or misrepresentation of persons
• Anything that violates the federal, state or local laws where the Customer resides
• Anything that may harm us, the server, or anyone else

If such material is found on any account or domain, MPG may gather and disclose this information to the appropriate legal authorities for prosecution of the violation. The data may also be deleted immediately upon discovery. This depends on the data and is decided case by case. MPG actively scans data hosted on our services for violations of this TOS.

Payment

Service begins once the first payment is received. Recurring services are billed on the schedule set out in the Customer’s agreement. Additional services added to a hosting account are prorated to that account’s billing date, and setup fees are charged in full when the service is requested.

MPG may suspend service on accounts that are past due, or end this agreement if charges are not paid when due. Suspension or termination does not relieve the Customer of responsibility for paying all accrued service fees.

Account cancellation

Requests to cancel any service must be made with at least 15 days’ notice, but not more than 30 days, through our contact form. Please include your domain name and the name on the account.

Refunds and disputes

Unless your agreement says otherwise, payments to MPG are nonrefundable, including setup fees and monthly fees, regardless of usage. All billing disputes must be reported within 30 days of the time the dispute occurred.

The content of this website, including the MPG name and logo, belongs to Midnight Publishing Group, Inc. unless otherwise noted. Journal posts discuss and link to the work of other artists, whose work remains their own. Links to other websites are provided for convenience; we are not responsible for their content.

Changes

We may update these terms from time to time. The date at the top of this page shows when they last changed.
